PAKISTAN INVOKES RIGHT TO SUSPEND BILATERAL PACTS, INCLUDING SIMLA AGREEMENT

Issue: Diplomatic and Treaty Dispute, 2025

Amidst rising tensions post-Pahalgam terror attack, Pakistan has invoked its right to suspend all bilateral pacts with India, including the Simla Agreement. It also responded to India’s Indus Waters Treaty suspension, warning of strong retaliation while shutting down border transit, airspace, and trade routes.

  • Vienna Convention on the Law of Treaties, 1969: Governs suspension or termination of international treaties.
  • Simla Agreement, 1972: A bilateral pact binding peaceful resolution and LoC status.
  • Indus Waters Treaty, 1960: World Bank-brokered water-sharing treaty; violation seen as grave.
  • SAARC Visa Exemption Scheme (SVES): Regional agreement on visa-free travel among SAARC members.

SIMLA AGREEMENT: ITS ORIGIN, VIOLATIONS BY PAKISTAN 

Issue: Simla Agreement and Its Breaches

Signed in 1972 post the Indo-Pak war, the Simla Agreement aimed to foster peaceful bilateral ties. Pakistan has violated the pact multiple times—most notably in Siachen (1984), Kargil (1999), and repeated ceasefire breaches. Its recent move to hold the agreement in abeyance threatens regional stability and challenges the legitimacy of the LoC.

LEGAL PROVISION 
  • Clause 4 (2): Respect for the Line of Control; no unilateral alteration.
  • Clause 5: Ratification essential for the agreement’s implementation.
  • Karachi Agreement 1949: Established ceasefire demarcation, including NJ9842 to glaciers.
  • UN Resolutions 1948–49: Called for cessation of hostilities and ceasefire line.
  • International Customary Law: Binding nature of bilateral agreements once ratified.
  • Violation Consequences: Undermining LoC questions territorial legitimacy and invites diplomatic backlash.

KOHLI CLIMBS TO SECOND ON IPL 2025 ORANGE CAP CHART; HAZLEWOOD TIES FOR PURPLE CAP
