SC rules on HC intervention in investigations, overturns Karnataka HC’s DA case verdict, and refuses PIL transfer on a lifetime election ban for convicted politicians.

SC: NO ABSOLUTE RULE BARRING HC FROM INTERFERING IN S.482 CrPC PETITIONS AT INVESTIGATION STAGE

Case: Kulandaisamy & Anr. vs. State Represented by Its Inspector of Police & Anr.

The Supreme Court said that High Courts are authorized to entertain Section 482 CrPC petitions at any stage, which also includes preliminary investigation before filing a charge-sheet. The apex court in this respect nullified the refusal of the Madras High Court to quash the First Information Report (FIR) against an allegedly misappropriated fund and directed reconsideration on merits.

SC OVERTURNS KARNATAKA HC DECISION IN DISPROPORTIONATE ASSETS CASE

Case: State vs. G. Easwaran

The Supreme Court set aside the judgment of the Karnataka High Court, which quashed a disproportionate assets case against a bureaucrat and stated that the probabilities of conviction and the validity of sanction should be examined at trial stage. It held that the HC exceeded jurisdiction conferred upon it under Section 482 of the Code and directed an expedited trial.

SC REFUSES TRANSFER OF PIL ON LIFETIME BAN FOR CONVICTED POLITICIANS

Case: Ashwini Kumar Upadhyay vs. Union of India & Anr.

The Supreme Court will not accede to hearing a Petition of Public Interest Litigation (PIL) that calls for speeding up the disposal of criminal cases against the elected representative bodies. Such prohibition would apply lifelong against politicians convicted of criminal activities. The Court seemed to appreciate it as a matter of public interest and has scheduled the case for April 8.
