VASUNDHARA OSWAL’S ORDEAL IN UGANDA: FALSE CHARGES-HUMAN RIGHTS VIOLATIONS & LEGAL BATTLE

INTRODUCTION 


Last year in October Vasundhra Oswal, 26 year Daughter of Pankaj Oswal of Oswal Group Indian Origin Millionaire based in Switzerland. She was detained by Uganda Jail for the false Allegation and held as a prisoner in Uganda. While talking to PTI she revealed some shocking facts about her detention. 

OVERVIEW


On 1st October 2024, Pankaj Oswal’s daughter Vasundhara Oswal was detained in Uganda on suspicion of abducting and killing Mukesh Menaria, a former employee of her father, who was subsequently discovered alive from Tanzania. She was denied basic requirements and subjected to alleged police wrongdoing during her weeks-long incarceration in cruel conditions. Even though she was granted bail and her case was ultimately dropped, Vasundhara is still pursuing legal action for her suffering.

FACTS

  • Arrested on October 1, 2024, granted bail on October 21.
  • Charged with kidnapping and murder despite Menaria being found alive in Tanzania.
  • Alleged mistreatment: denial of food, water, and showers, unlawful detention, and forced statements.
  • Case dismissed on December 19, 2024, but Ugandan police allegedly extorted money before dropping charges.
  • Pankaj Oswal sought intervention from Uganda’s President and enlisted human rights lawyer Cherie Blair.

LEGAL PROVISIONS

Vasudhara was in illegal detention by Uganda, here are some International laws which are applicable in this case- 

  • Wrongful Arrest and Detention: Article 9 of the International Covenant on Civil and Political Rights (ICCPR), as per Article 9 arbitrary detention without following due process violates Fundamental rights of human.
  • Prohibition of inhumane Conditions: Article 5 of the Universal Declaration of Human Rights (UDHR), depriving basic rights of food and water.
  • Right to Fair Trial: Article 14 of the ICCPR, gives right to individuals for fair trial in her case she was forced to write a statement without her criminal lawyer.
  • Extortion of Money by Police in name of providing her basic amenities: Anti-corruption laws under the United Nations Convention Against Corruption (UNCAC).
  • Arrest and Search without warrant: Breaches Section 27 of the Ugandan Constitution
  • Investors Rights:  Bilateral Investment Treaties (BITs)- This treaty protects investors from the unlawful action against them within the state.

INSIGHTS

Vasundhara’s case highlights serious concerns about the abuse of legal systems in foreign jurisdictions, potential corruption in law enforcement, and the vulnerability of expatriates facing wrongful detention.

AFTERMATH

Her ordeal has sparked international human rights debates and raised concerns over investor protection in Uganda. It also underscores the role of diplomatic intervention in securing justice for detained foreign nationals.

CONCLUSION 

The incident sheds light on the arbitrary use of power, human rights violations, and the need for stronger legal protections for individuals caught in wrongful detentions abroad.
