
Income Tax Return filing for AY 2025-26 delayed due to inactive e-filing utilities.
Gist of the NewsThe Income Tax Department has released all the forms for filing Income Tax (IT) returns for AY 2025-26, extension of ITR Due Date for AY 2025-26. Even then, the taxpayers cannot file their IT returns as the e-filing tools, called utilities, that help submit these forms aren’t working at the moment. This has led to confusion as to whether this delay will cause the authorities to extend the time for filing IT returns. |
Legal Aspects
The following provisions govern the filing of IT returns:
- Rule 12 of the Income Tax Rules, 1962: This Rule provides for forms ITR-1 to ITR-7. ITR-1 to ITR-4 apply to individuals and HUFs based on their income sources, ITR-5 is used by firms ad LLps, ITR-6 by companies and ITR-7 by trusts, political parties and institutions.
- Section 139(8A) of the Income Tax Act, 1961: This Section provides that ITR-U form can be used by taxpayers to file an updated return of income within 24 months from the end of relevant assessment year.
- Rule 12(3) of the Income Tax Rules, 1962: This Rule provides that the ITR-V form should be used by taxpayers who file their returns online without a digital signature or Aadhar based e-verification.
Conclusion
As of now, the last date of filing returns for taxpayers who do not require an audit is July 31st 2025. Generally, IT returns are filed in the months of June and July and the month of June has not started yet. So, the authorities may release it anytime and the taxpayers shouldn’t assume that there will be an extension unless the authorities provide information regarding the same.
