The important definitions have been classified under Section 2 of the new Bharatiya Nyay Sanhita, providing clarity on concepts and their interpretations unless otherwise specified by the context. Legal terms that are essential to understanding offenses are covered in this section, including “act,” “animal,” “counterfeit,” “court,” “death,” and many more.
Furthermore, even if these exceptions are not expressly mentioned, Section 3(1) underlines that every definition of a crime, penal provision, and illustration must be understood in connection with the general exceptions.
DEFINITIONS
Previously, these definitions existed defined between Sections 6 to 52A of the Indian Penal Code (IPC). The new Sanhita streamlines them in an effort to improve comprehension and accessibility of the legal system. This represents a major shift in the way the law is organized, reflecting Sanhita’s goal to improve and modernize India’s criminal justice system.
