LAW AND GOVERNANCE

Supreme Court Justices Reflect on Dr. BR Ambedkar’s Legacy and Article 32 Challenges

Justice BR Gavai emphasized Dr. BR Ambedkar’s pivotal role in his Supreme Court journey, noting Article 32’s transformative justice potential. Set to become Chief Justice of India in May 2025, he’s poised to be the second Dalit in the role. Justice AS Oka raised concerns over the Supreme Court’s backlog, suggesting a debate on restricting Article 32 use. He highlighted the court’s challenge in prioritizing cases, citing disparities between common convicts and businessmen’s appeals. The call for debate on Article 32 enforcement reflects ongoing discussions on balancing access to justice with the court’s capacity amidst mounting caseloads.

Supreme Court Denies Anticipatory Bail to AAP MLA Amanatullah Khan in Money Laundering Case

The Supreme Court rejected anticipatory bail for AAP MLA Amanatullah Khan in a money laundering case linked to alleged recruitment irregularities in the Delhi Waqf Board during his tenure. Khan’s lawyer assured his appearance before the Enforcement Directorate (ED) on April 18. The court directed the ED to withdraw its non-bailable warrant application if Khan complies. However, the court expressed reservations about certain interpretations in the order, keeping the legal question open. It emphasized adherence to procedure under Section 19 of the Prevention of Money Laundering Act and clarified that observations in the High Court’s order wouldn’t prejudge the case’s merits.

Bombay High Court Affirms Right to Sleep as Fundamental Human Need

The Bombay High Court has made a significant ruling affirming that the right to sleep is a basic human necessity. In a recent case, the court directed the Enforcement Directorate (ED) to refrain from conducting interrogations during late hours, recognizing that depriving individuals of sleep violates their fundamental rights. This decision came during a hearing where a petitioner, Ram Kotumal Issrani, challenged his arrest, arguing that being interrogated all night infringed upon his right to sleep and his right to life, as outlined in Article 21 of the Constitution. While the court didn’t find the arrest illegal, it criticized the practice of conducting interviews late at night, emphasizing the importance of treating individuals with dignity and respecting their basic rights.
