SUPREME COURT SEEKS RESPONSE ON DEPORTATION OF 211 FOREIGN NATIONALS IN ASSAM
Case Name: Rajubala Das vs. UOI & Anr
Recently the Supreme Court has asked the Union Ministry of Home Affairs and the Assam Government regarding deportation. There is a report of deportation of 211 foreign nationals that were detained in Assam’s Matia Tansit Camp. As per the reports of Assam Legal Services Authority, the current condition of detention centres at Assam is terrible, the Court highlighted that as well and also accentuated the need for coordination between Union and state in deporting foreign nationals.

- Section 3 of Foreigners Act, 1946: Gives authority to the Central Government to deport and repatriate to foreign nationals
- MHA Affidavit (August 14, 2023): Grants powers to state governments on deportation.
- SC’s Observation: The condition of detention centres should be improved and the government at both levels should keep a check on deportation.

SUPREME COURT ORDERS RELEASE OF MEDICAL STUDENTS’ DOCUMENTS IN FEE DISPUTE CASE
Case Name: Sahil Bhargava vs. State of Uttarakhand
The Supreme Court on September 9 passed an interim order directing Shri Guru Ram Rai Institute of Medical and Health Sciences to release original documents of students upon payment of ₹7.5 lakhs towards arrears. The petitioners were unable to apply for the NEET-PG exams because they had withheld the students’ documents with themselves because they had challenged the college’s fees hike.
Legal Framework:
- Right to Education: Withholding of documents violates the fundamental right to education.
- Previous Uttarakhand High Court Order (February 28, 2024): Directed students to pay the fee in instalments.
- Supreme Court Interim Order: Allows students to retrieve documents upon partial payment and submission of an undertaking to settle the remaining arrears.

GOVERNMENT APPOINTS SIX NEW ADDITIONAL SOLICITOR GENERALS IN SUPREME COURT
On 9th of September, the Union Government appointed six senior advocates as Additional Solicitor Generals (ASG) in the Supreme Court of India. The Appointments Committee of the Cabinet (ACC) approved their appointment for a three-year term. New ASGs are S. Dwarakanath, Archana Pathak Dave, Satya Darshi Sanjay, Brijender Chahar, Raghavendra P. Shankar, and Rajkumar Bhaskar Thakare.
Legal Framework:
- Article 76 of the Indian Constitution: Defines the role of the Attorney General for India and ASGs who assist in legal matters for the Union Government.
- Appointments Committee of the Cabinet (ACC): Authorizes the appointment of ASGs.
- Three-year Tenure: The appointed ASGs will serve a fixed term, unless terminated earlier.
- Supreme Court Jurisdiction: ASGs represent the government in significant cases before the apex court.
