LAW AND GOVERNANCE

Hindu Marriage Sanctity Reinforced by Supreme Court Ruling

In the case of Dolly Rani v. Manish Kumar Chanchal, the Supreme Court clarified the requisites and sanctity of Hindu marriages under the Hindu Marriage Act 1955. The ruling emphasized the importance of adhering to traditional Hindu marriage rites and ceremonies, stating that mere registration is not enough to validate a Hindu marriage without following prescribed customs. The decision reaffirms the sacred nature of Hindu marriages and discourages ceremonies lacking proper observance.

Supreme Court Deliberates on Private Resources and Community Welfare

In ongoing proceedings, the Supreme Court Constitution bench analyzed whether private resources constitute part of the ‘material resource of the community’ under Article 39(b) of the Constitution. It discussed the evolving economic dynamics in the context of globalization and argued for an interpretation of Article 39(b) that balances collective and individual interests, considering India’s policies on liberalization and foreign investment. The bench highlighted the need to maintain a balance between social and personal rights, recognizing the impact of its decision on India’s economic future.

Supreme Court Criticizes Delhi Police Over Handling of NewsClick Editor’s Arrest

The Supreme Court criticized the Delhi Police Special Cell for hastily producing NewsClick editor Prabir Purkayastha before a magistrate without informing his lawyer. The court questioned the urgency of producing Purkayastha at 6 am, stating that the principles of natural justice required his lawyer to be informed in advance. Purkayastha’s lawyer argued that his client’s arrest was illegal, as he was not provided with the grounds of arrest. The court reserved its orders on Purkayastha’s plea challenging his arrest and remand in a UAPA case related to alleged Chinese funding for ‘anti-national propaganda’ through NewsClick.
