TERMINATION OF 24+ WEEKS PREGNANCY OF A MINOR RAPE VICTIM IS PERMITTED: CHHATTISGARH HC

Case Name: ABC (Minor) Through Natural Guardian XYZ V. State of Chhattisgarh & Ors.

A single-judge bench of Justice Bibhu Datta Guru, while referring to other cases wherein reproductive autonomy under Article 21 was considered while deciding on pregnancy termination, observed that a victim of rape cannot be compelled to bear a child. Abortion of a 24-week, 6-day-old fetus was allowed after examining Section 3 of the Medical Termination of Pregnancy Act, 1971.

While reiterating the ruling of Mangla Ram v. Oriental Insurance Co. Ltd. & Ors., the bench held that police chargesheets and records can be relied upon by the Motor Accident Claims Tribunal while dealing with questions of negligence in accident claims.

EVICTION AND TRANSFER OF POSSESSION BY MAINTENANCE TRIBUNAL IS NOT BEYOND ITS POWER: SUPREME COURT

Case Name: Urmila Dixit v. Sunil Sharn Dixit & Ors.

In an appeal filed by a mother under section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, to annul a gift deed executed in favor of her son due to his failure in fulfilling the obligation of looking after her, the court held that the tribunal has the power to issue an order for eviction and transfer of property.
