Stay On Cancellation Of EWS Certificate, Raising Questions On The Inquiry Process: J&K HC

Case Name: Ajay Kumar Sareen Vs U.T. Of J&K And Ors.

In a petition where a person’s EWS certificate was cancelled on an assumption of non-disclosure of key facts of a property belonging to his father, a bench of Justice Wasim Sadiq Nargal observed that the Deputy Commissioner acted on a presumption that the petitioner has committed a fraud, without adhering to Principles of Natural Justice. A person has to be given an opportunity to defend himself and present his own version of the case ensuring just and fair inquiry.

Fees By Bar Councils For Verification Of Certificates Of Applicants Is Not Permissible: Kerala HC

Case Name: Alan Benny vs Bar Council Of Kerala And Anr.

The direction dated January 28,2017 issued by Bar Council of India to Bar Councils requiring to impose a fee of Rs. 2,500 for verification of certificates cannot be carried out. The bench also considered a decision where the court ordered State Bar councils not to receive a fee more than the enrolment fee which was Rs. 600 and Rs 150 ( General category) and Rs 100 and Rs 25 (Scheduled castes and scheduled tribes) for Bar Council of India and State Bar councils respectively as under Section 24 (1) (f) of the Advocates act of 1961 .

Wife Is An Individual With Sole Rights On Her Body, Privacy and Sharing Videos Of Intimate Acts Without Consent Is Wrongful: Allahabad HC

Case Name : Unknown

In a case where the husband was accused for recording and sharing the intimate acts without wife’s consent, the court observed that being a legally wedded husband does not confer any control or ownership over the wife. Privacy is an intrinsic part of Article 21 and includes the preservation of intimacies, marriage, procreation, family life etc as was observed in K.S. Puttaswamy’s case. Recording and sharing videos is a breach of trust and breach of sanctity of marriage.
