CASE SUMMARYIn Sanjay Prakash & Ors. vs. Union of India & Ors., the Supreme Court addressed the longstanding grievances of CAPF officers regarding denial of OGAS status and the associated benefits like NFFU.SC recognizes CAPFs as OGAS, directs promotion parity and NFFU benefits, the government to implement cadre reviews. The Court reiterated that CAPFs were previously acknowledged as OGAS in multiple official documents and court rulings, including Harananda. It criticized the continued deputation of IPS officers causing stagnation for CAPF officers. The DoPT’s OM dated 12.07.2019 treating CAPFs as OGAS was pivotal. The Court directed the Union to grant all related benefits, conduct cadre reviews, and amend recruitment rules accordingly.

Current Scenario DoPT and MHA are now mandated to recognize CAPFs as OGAS across functions. Cadre reviews, recruitment rule amendments, and promotional parity are to be implemented.
