The Waqf (Amendment) Bill, 2024 to be tabled in Lok Sabha on 2nd April 2025 aiming to regulate Waqf properties effectively.

Overview

The Waqf (Amendment) Bill, 2024 was first introduced in Lok Sabha in August 2024, seeking to amend the Waqf Act, 1995. The Bill was sent to a Joint Parliamentary Committee (JPC) which submitted its report in February 2025. The legislation focuses on redefining Waqf property regulations, ownership needs and administrative control.

  • Renaming the Act : The Bill proposes renaming the law to the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995.
  • Restrictions on Waqf Declaration: Only individuals practicing Islam for at least 5 years can declare a Waqf, provided they own the property.
  • Removal of Waqf-by-User : Properties used for religious purposes over time cannot automatically be deemed Waqf.
  • Changes in Waqf Council Composition: 2 non-Muslims can be appointed as members but representatives of Muslim organizations must be Muslims including 2 women.
  • Appeals Against Tribunal Decisions : The Bill permits appeals against Waqf Tribunal decisions in the High Court within 90 days.
