Volenti Non Fit Injuria

Meaning: No injury can be done to a willing person.

  • Volenti – To one who is willing (from “volens,” meaning willing or consenting).
  • Non – Not.
  • Fit – Is made or happens.
  • Injuria Injury, harm, or injustice.

Interpretation: If a person voluntarily consents to an injury, he must bear the loss. One cannot claim damages for the injury he consented to.

Example: The plaintiff took an action against the defendant, but the court dismissed it on the ground of volenti non-fit injuria. By consenting to play hockey and accept its risks, the plaintiff gave implied permission to risk injury.
