On July 28, the Supreme Court of India issued notice in a Special Leave Petition challenging the Delhi High Court’s acquittal of a man previously convicted of sexually assaulting a 14-year-old girl . The plea was filed by Just Rights for Children Alliance through AoR Sonali Jain . A bench of Justice Dipankar Datta and Justice AG Masih issued notice, returnable in four weeks . The Delhi Police, represented by ASG Archana Dave supported the petition and also proposed filing an appeal .

  • The High Court reasoned that ambiguous terms like “physical relation” or “samband” were insufficient to meet the legal threshold under these provisions .
  • The Supreme Court will now examine if such interpretation undermines statutory protections under POCSO .

Court’s Verdict

The Supreme Court has issued notice and will hear the matter after four weeks . No final judgment yet, but the Court signalled concern over the Delhi High Court’s narrow interpretation .
