SUPREME COURT OF UNITED STATES CLEARS RANA’S EXTRADITION

HEADLINE:

Supreme Court of USA has rejected the final plea of Tahawwur Rana and also approved extradition to India

SUMMARY:

Recently in Nov ’24 Tahawwur Rana filed for writ of certiorari in United States Supreme Court against his extradition to India, but US SC has “DENIED PETITION”.  This marks the milestone for mumbai attack on 26/11.The Canadian businessman of Pakistan origin has been accused of providing logistic support to the Mumbai 26/11 Attackers.Rana is associated with chief conspirator of the 26/11 attack David Coleman Headley ( Daood Gilani) and others located in Pakistan and Terrorist organisation LeT in carrying out the attack.

KEY ASPECTS:

  • Who is Tahawwur Rana?: Rana, a Pakistani national who served as a doctor in Pakistani Army, later a Canadian Businessman, is linked to David Coleman Headley also known as Daood Gilani one of the masterminds of the Mumbai attacks.
  • India’s Charges Against Rana: Rana is accused of organising and facilitating the attackers in the 26/11 case in India. He is accused of aiding the Lashkar-e-Taiba terrorist organisation.Not only this nut he is also charged in forgery and submission of false information while setting up his office in India.
  • Legal History: Rana has been under US authorities for different charges which he was proven not guilty of, but India’s charges are not covered under that trail.While he has filed for relief from the extradition to India, which has been denied by US’s Apex court following his defeat in multiple lower courts as well for the same.
  • US Government’s Role: The US Solicitor General Elizabeth B Prelogar argued that Rana’s actions warranted extradition under the India-US Extradition Treaty of 1997. This also highlighted that the charges which Indian Government has mentioned as new and are trailed in US Courts, this paved the way in strengthening the extradition charges against him.

  • For India as well, it’s not a legal victory against terrorism it’s also a justice for the victims and their family so that they can heal peacefully from the fact that they got justice. 
  • For the World it’s a reminder that united we can stand against such heinous crimes, maintain rule of law globally as well and if divided we can lose such culprits of humanity.
