SUPREME COURT DENIES POSTPONING CA EXAMS AMID ELECTIONS

by | Apr 29, 2024

Background:

In the case of Varad Balwant Vasant and Ors, W.P.(C) No. 255/2024, the Supreme Court adjudicated on a petition seeking the postponement of Chartered Accountant (CA) exams conducted by the Institute of Chartered Accountants of India (ICAI) due to the overlap with the Lok Sabha elections.

Key Points:

  • The petitioners argued that scheduling the CA exams on the 8th and 14th of May, immediately following the elections on the 7th and 13th of May 2024, would impose significant challenges for students.

  • Senior Advocate Madhavi Divan, representing the petitioners, highlighted the logistical difficulties students from remote areas would encounter in reaching exam centers after voting.

  • The bench acknowledged the enrollment of over 4.36 lakh students for the exams and recognized the substantial hardship postponement would cause.

  • It was observed that 591 exam centers had been established across India, with no exams scheduled on the polling dates.

Legal Provisions:

  • The petition was evaluated in light of the potential adverse effects on students and the practical considerations involved.

  • The court examined the ramifications of providing opt-out options, considering the impact on students attempting all papers in a single sitting.

Legal Analysis:

  • The court assessed the feasibility of postponing the exams and the implications for the large student population involved.

  • Consideration was given to the arrangements made by the ICAI and the absence of exams on polling dates.

Conclusion:

Following thorough deliberation, the bench, comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwala, and Manoj Misra, dismissed the plea to postpone the CA exams. The court emphasized the significant hardship that postponement would inflict on students and accepted the ICAI’s argument against providing opt-out options.
