Meaning – All the acts are presumed to have been done rightly and regularly.
- Omnia – All things.
- Praesumuntur – Are presumed.
- Rite – Correctly, properly, or in the proper manner.
- Et – And.
- Probetur – Must be proven or should be proven (from “probare,” to prove).
- Contrarium – Contrary (opposite).
- Solenniter – Solemnly or formally.
- Esse – To be.
- Acta – Acts, deeds, or actions.
Interpretation-When acts are of official nature and went through the process of scrutiny by official persons it is presumed that all things have been rightly and duly performed until it is proved to the contrary.
Example -under Section 114 of the Indian Evidence Act presumes that a person who is in the possession of stolen property soon after the theft is either the thief or received the property knowing they were stolen.
