Ex Injuria Jus Non Oritur

Meaning-Law (or right) does not arise from injustice.

  • Ex – From, out of.
  • Injuria – Injury, wrong, or harm.
  • Jus – Law, right, or justice.
  • Non – Not.
  • Oritur – Arises, originates, or comes into being.

Interpretation-A legal right or entitlement cannot arise from an unlawful act or omission. When a fact arises from an illegal or unlawful act or omissions, it cannot form the basis of law or legal rights, even if it is public or prominent.

Example – if a person seeks to smash and enter your house in the middle of the night and unfortunately falls into a deep construction hole, he could be estopped or precluded from obtaining damages because of ex injuria.
