DR SHAHID IQBAL CHOUDHARY GIVEN ADDITIONAL CHARGE AS CIVIL AVIATION COMMISSIONER

Case Name: In re Appointment of Public Officials under Article 309

Dr. Shahid Iqbal Choudhary, a 2009-batch IAS officer and current Administrative Secretary of the Tribal Affairs Department in Jammu and Kashmir, has been assigned additional charge as Commissioner of Civil Aviation. This appointment aims to streamline aviation development and regulation in the Union Territory.

Legal Provision 

The legal provisions are mentioned below – 

  • Article 309 of the Indian Constitution allows the framing of rules for civil services under the Union and States.
  • DoPT Guidelines and J&K Reorganization Act, 2019 regulate such administrative assignments.

BABYDOLL ARCHI CASE SPARKS CONCERN OVER INDIA’S DIGITAL PORNOGRAPHY CRISIS

Case Name: In re Obscenity and Cyber Pornography – Babydoll Archi Case

Assam police arrested “Babydoll Archi,” an adult content creator, raising debates about India’s rising porn consumption and creators’ legal vulnerability. While public morality is cited, the incident exposes the grey zone between artistic freedom, adult content, and criminality under cyber laws.

Legal Provision 

The legal provisions are mentioned below – 

  • Section 67, 67A of IT Act, 2000 – Punishment for publishing obscene and sexually explicit material.
  • Section 292 IPC – Deals with obscenity.
  • Supreme Court in Aveek Sarkar vs. State of West Bengal (2014) clarified the test for obscenity must be community standards-based.
  • The Shreya Singhal judgment (2015) stressed the need to balance free speech with reasonable restrictions.

KERALA HC CLOSES JSK MOVIE CASE PETITION AGAINST PRODUCERS

Case Name: JSK Movie Case – High Court Petition Closure

The Kerala High Court closed a petition against the producers of the controversial Malayalam film “JSK”, after the complainants chose not to pursue the case. The petition accused the producers of promoting religious disharmony, but the court found no grounds for further proceedings.

  • Sections 153A and 295A IPC – Promote enmity between groups and deliberate acts to outrage religious feelings.
  • Article 19(1)(a) – Freedom of speech and expression.
