LAW & GOVERNANCE

CONVICT REQUESTS PAROLE TO ATTEND MOTHER’S LAST RITES

Muzammil Shaikh, a convict in the 2006 Mumbai train bombings, has petitioned the Bombay High Court for parole to perform his mother’s last rites. He seeks parole without a police escort or the associated fees, citing financial hardship and his previous compliance during an earlier parole.

Legal Framework:
  • Prison Rules and Parole Regulations: Parole in India is governed by various prison rules and state-specific regulations. These rules typically allow for emergency paroles in situations such as the death of an immediate family member.
  • Maharashtra Prisons (Bombay Furlough and Parole) Rules, 1959: This regulation outlines the conditions and procedures under which a convict can be granted parole.
  • Indian Penal Code (IPC): Although the IPC does not explicitly mention parole, related provisions such as Section 432 and Section 433 of the Criminal Procedure Code (CrPC) deal with the suspension, remission, and commutation of sentences.
Legal Provisions:
  • Parole for Emergency Situations: The prison rules allow convicts to apply for emergency parole in cases of family emergencies like the death of a parent.
  • Conditions and Costs: Regulations often require convicts to cover escort costs and ensure that parole does not pose a security risk. Shaikh’s plea highlights his financial inability to pay these charges, seeking exemption based on indigence.

CAT CRITICIZES GOVERNMENT FOR BLOCKING STAFF REGULARIZATION

The Central Administrative Tribunal (CAT) has condemned the Union Government’s interference in regularizing its staff, calling it a threat to judicial independence. The Tribunal directed the regularization of three Stenographers employed since 2012, highlighting the government’s overreach into judicial administration.

  • Administrative Tribunals Act, 1985: This act establishes the framework for the functioning of administrative tribunals in India, including their powers and administrative independence.
  • Constitution of India: Article 323-A provides for the establishment of administrative tribunals for adjudication of disputes related to public service.
Legal Provisions:
  • Section 12 of the Administrative Tribunals Act, 1985: This section grants the Chairman of the Tribunal administrative and financial powers, underscoring the tribunal’s independence from government control.
  • Judicial Independence: The Supreme Court’s observations in the Madras Bar Association cases emphasize that tribunals should operate independently and not as extensions of the executive branch.

SUPREME COURT URGED TO NULLIFY NEET-UG RESULTS

A petition filed in the Supreme Court challenges the validity of NEET-UG 2024 results, alleging inconsistencies and arbitrary awarding of grace marks. The petitioners call for a fresh exam and an investigation into possible malpractices, including claims of a question paper leak and irregularities at specific test centers.

  • National Testing Agency (NTA): Established to conduct entrance examinations for higher educational institutions, NTA operates under the Ministry of Education and follows specific guidelines to ensure fair and transparent examination processes.
  • Supreme Court of India: Under its writ jurisdiction (Article 32 for the enforcement of fundamental rights and Article 226 for wider jurisdiction), the Supreme Court can hear petitions challenging the fairness of national exams.
Legal Provisions:
  • Principle of Natural Justice: Petitioners argue that discrepancies in NEET-UG results violate principles of fairness and transparency.
  • Judicial Review: The Supreme Court can review administrative actions to ensure they comply with legal standards and do not exhibit arbitrariness or malafide intentions.
  • Special Investigation Team (SIT) Request: Petitioners seek the formation of an SIT under the Supreme Court’s supervision to investigate alleged malpractices, referencing past precedents where such interventions ensured fairness in examinations.
