OBJECTION BY A COMMUNITY DOESN’T AFFECT THE RIGHT TO PRAY UNDER ARTICLE 25: MADHYA PRADESH HC

Case Name: Vijay Katara Vs Principal Secretary and Ors.

In a petition filed by a person belonging to Christian Community questioning the order that has been passed to stop conducting the new year program which he was organizing since many years, the court observed that, the order was passed merely on an objection raised by Vishva Hindu parishad  without hearing the other party which is violative of Principles of natural justice. The freedom of religion guaranteed under Article 25 cannot be taken away in such a case.

GOVERNMENT ORDER DIRECTING TO ONLY CHARGE TUITION FEES DURING COVID-19 LOCKDOWN WAS UPHELD-: UTTARAKHAND HC

Case Name: Welham Boy’s School Society &Ors. Vs State of Uttarakhand & Anr.

The GO passed by State government in 2021 mandating the private unaided residential schools to receive only tuition fee for the virtual classes held and not to charge for the services which were unprovided during the covid 19 lockdown period is valid as it is within the ambit of Article 162 of the Constitution.

ABSCONDED ACCUSED CAN BE PROSECUTED UNDER S.174A IPC EVEN IF PROCLAMATION UNDER S.82 CrPC IS EXTINGUISHED: SC

Case Name: Daljit Singh Vs. State Of Haryana & Anr.

A case wherein the failure of a person to appear before court in a cheque dishonor case attracted the provisions of Section 82 CrPC and Section 174A of IPC, the court observed that, though section 82 of CrPC is nullified after quashing of the case, the person can still be made liable under Section 174A of IPC.

  • Section 82, Code of Criminal Procedure -Proclamation for person absconding.
  • Section 174A, Indian Penal Code- Non-appearance in response to a proclamation under Section 82 of CrPC.
