SUPREME COURT ISSUED NOTICE UNION & STATES FROM REDUCING FOREST LAND

Case Name: Ashok Kumar Sharma, Indian Forest Service (Retd) & Ors. vs. Union of India & Anr

In a recent order passed by the bench of Justice BR Gavai and K Vinod Chandran regarding Union and states using forest lands. The bench ordered that the Government can not use forest land until or unless compensatory land is provided for afforestation. The court has issued notice on this interim application if it is not counterbalanced then you can not use forest lands.

SC ISSUES NOTICE ON PLEA CHALLENGING RESTRICTED ACCESS TO ELECTION RECORDS

Case Name: Anjali Bhardwaj vs. Union of India

The Supreme Court of India has issued notice to the Central Government and Election Commission of India on a plea challenging the 2024 amendment in Election Commission Rules, 1961. This Rule 93(2)(a) restricts public access to election related records. This rule directly violates Article 19(1)(a) and Article 21 of Indian Constitution.Anjali Bhardwaj has filed a petition for transparency and accountability in her plea challenging the amended rules of Election rules.

SC RULES EXCESSIVE FORFEITURE OF EARNEST MONEY UNFAIR & UNREASONABLE

Case Name: Godrej Projects Development Ltd. vs. Anil Karlekar & Ors., 2025 LiveLaw (SC) 150

Recently the Supreme Court heard a case of Builder-buyer agreement where SC ruled that excessive forfeiture of earnest money in real estate or flat booking is unfair trade practice. SC also mentioned builders can not impose one sided clauses & also there must be some reasonable restriction for penalising homebuyers under section 74 of Indian Contract Act, 1872.
