Actus me invito factus non est mens actus

by | Jan 2, 2024

Actus me invito factus non est mens actus – It means an action committed by me against my wishes cannot be regarded as my own deed.

  • Actus :-action or act
  • Invito factus:- done against one’s will
  • Non est :-it is not
  • Mens actus :-mental element of the action

Example If A is compelled by B at gunpoint to attack C, any subsequent assault by A upon C would be considered involuntary, lacking freedom of choice, and attributed to external force, thus disassociating it from A’s own willful action.
