In a significant ruling impacting Landlord-Tenant Disputes, the Supreme Court of India comprising Justice Abhay S Oka and Justice Ujjal Bhuyan explained that under the Maharashtra Rent Control Act, the landlord-tenant relationship terminates only upon the passing of an Eviction Decree. The decision came in response to a direction for mesne profit calculation from the suit filing date which was later revised to begin from the date of decree.

The Supreme Court of India held that a possession of the tenant becomes unlawful only after the Eviction Decree is passed. The trial court’s earlier order was modified accordingly by reinforcing settled law in Landlord-Tenant Disputes under the Maharashtra Rent Control Act.
