CASE IN NEWS
DMK filed a Writ petition in the Supreme Court on Monday challenging the recently passed the Waqf (Amendment) Act and also said it is a blatant attack on the minority rights.
CASE OVERVIEW
The ruling party in Tamil Nadu, Dravida Munnetra Kazhagam (DMK), has moved the Supreme Court by filing a writ challenging the constitutional validity of Waqf (Amendment) Act 2025. The petition was filed by DMK MP A. Raja and settled by Rajya Sabha MP P. Wilson. DMK states that the Act violates the rights of millions of Muslims and were passed without considering serious objections raised in both the Joint Parliamentary Committee (JPC) and the Parliament.
LEGAL INSIGHTS
- It is alleged that Articles 14, 21, and 25 of the Constitution have been violated.
- It has not been subject to any serious parliament debate, nor was any dissenting view seriously considered.
- Coupled with the ones previously filed by some political heavyweights and Muslim organizations, this petition is beginning to swell in numbers.
IMPACT
The Act would always be challenged before the Court and make an impact on regulating Waqf properties all over India. It has implications for future legislative processes regarding minority rights.
FINAL NOTE
This important case will become a constitutional milestone in managing legislative coercion vis-à-vis minority rights in India’s secular democracy.
