
DENIAL OF TELEPHONIC CALLS TO TERROR OFFENDERS NOT ARBITRARY: DELHI HC
Case Name: Syed Ahmed Shakeel vs. Central Jail No.8, Tihar Jail & Anr.
The Delhi High Court has observed that prima facie, denying telephonic and electronic communication to prisoners involved in terrorism, MCOCA, and Public Safety Act and other multiple heinous offences,etc. is not arbitrary. The court while examining the validity of the impugned rule i.e Rule 631 of the Delhi Prison Rules, 2018, stated that the denial of these facilities is not absolute and may be allowed if it doesn’t pose a risk to public interest and safety.

DEATH SENTENCE COMMUTED TO LIFE IMPRISONMENT IN MULTIPLE MURDER CASE: SC
Case Name: Deen Dayal Tiwari vs. State of Uttar Pradesh
The Supreme Court upheld the conviction of a man for murdering his wife and four minor daughters but commuted his death sentence to life imprisonment without remission . The Court cited mitigating factors such as lack of prior criminal record, good prison conduct and potential for reform while reaffirming that death penalty should be only imposed in the “rarest of rare” cases, as established in Bacchan Singh Vs. State of Punjab.

DISCLOSURE STATEMENT ALONE INSUFFICIENT FOR CONVERSATION, ACQUITS ACCUSED: SC
Case Name: Vinobhai vs. State of Kerala
The Supreme Court acquitted the accused convicted under Section 302 IPC, as no evidence besides recovery of weapon was presented to prove the guilt beyond reasonable doubt. It emphasized that under Section 27 of the Indian Evidence Act, a disclosure statement without any supporting evidence is not sufficient for convicting an individual for a crime.
