FIR AGAINST A MAN DRIVING WITHOUT LICENCE AND HELMET QUASHED: BOMBAY HC

Case Name: Hushad Neville Bacha Vs. Eric Girgol Vegas 

While considering the young age of the man , the court quashed the FIR against him for driving without licence when he was 17 years old and helmet in 2017 and ordered him to perform community service for four Sundays at a hospital. Additionally the court directed the mother of the man to pay Rs 25,000/- to an NGO working for welfare of animals for her conduct with a police constable.

Legal Provisions:
  • Section 332 ,The Indian Penal Code, 1860-Voluntarily causing hurt to deter public servant from his duty.
  • Section 353 ,The Indian Penal Code, 1860-Assault or criminal force to deter public servant from discharge of his duty.
  • Section 504 in The Indian Penal Code, 1860-Intentional insult with intent to provoke breach of the peace.

DEATH SENTENCE GRANTED FOR KILLING BOYFRIEND, COURT REMARKS SHE KILLED HIM INCH BY INCH: KERALA COURT

Case Name:State of Kerala Vs. Greeshma @ Sreekkutty

Additional Sessions Court of Neyyattinkara  granted death penalty to Greeshma who killed her boyfriend Sharon Raj  with an ayurvedic poison. The court remarked that she killed him inch by inch and gave a message to society that a lover cannot be trusted. It rejected the plea of the accused for reduction of punishment.

  • Section 364 ,The Indian Penal Code, 1860-Kidnapping or abducting in order to murder.
  • Section 328 , The Indian Penal Code 1860- Causing hurt by means of poison, etc., with intent to commit and offence.
  • Section 203 The Indian Penal Code ,1860- Giving false information respecting an offence committed.

POLICE OFFICER’S TESTIMONY IS ADMISSIBLE  TO UPHOLD CONVICTION FOR FORGED DRIVING LICENCE: KERALA HIGH COURT

Case Name: Abhijit George Vs. Assistant Sub Inspector of Police

The court while addressing an appeal challenging the conviction of an auto rickshaw driver under section 471 of the IPC  for providing a forged driving licence during a vehicle inspection held that evidence provided by police officers can be accepted, if found credible and trustworthy, without any doubt solely based on their professional background .
