Factum probans – It means “the proving fact” or “the fact that proves” in English. It refers to the evidence or proof presented in a legal case to establish or support the “factum probandum,” which is the specific fact or issue under consideration that needs to be proven. So, “factum probans” represents the evidence or information that demonstrates or proves the central point in a legal argument or case.

  • Factum :- fact or thing
  • Probans :- to prove

Example In a theft case, the security camera footage showing the suspect taking an item from a store shelf is the “factum probans” that proves the central fact of the theft.
