SERVING NOTICES OF APPEARANCE VIA ELECTRONIC MEANS BARRED, TO BE SERVED ONLY THROUGH PRESCRIBED MODES: SUPREME COURT

Case Name: Satender Kumar Antil Vs. CBI

The Supreme Court has ruled that police cannot serve notices for the appearance of the accused under Section 41A of CrPC or Section 35 of BNSS via WhatsApp or electronic means. The court highlighted that such electronic methods of serving are not recognized methods prescribed under CrPC or BNSS and notices under Sections 179 and 195 of BNSS can be issued only through the modes prescribed under BNSS. In addition, guidelines to avoid unwarranted arrests and simplify granting bail to eligible undertrial prisoners were also laid down in the instant case.

Legal Provisions:

  • Section 41A, CrPC or Section 35, BNSS -provides for the issuance of notice to the accused to appear before the police.
  • Section 179 BNSS- Police officer’s power to require the attendance of witnesses.
  • Section 195 BNSS- Power to summon persons.

INQUIRY INTO ALLEGATIONS OF MISTREATMENT OF FOREIGN PRISONERS ORDERED: MADRAS HC

Case Name: Egwin Kingsley Vs. The Additional Chief Secretary and Ors.

The Madras High Court has directed the Superintendent of Puzhal Central Prison to investigate allegations that foreign prisoners are being denied breakfast and placed in solitary confinement. The Court stressed that all prisoners should be treated according to the prison manual as the treatment of foreign prisoners reflects India’s reputation pointing out the existence of international treaties concerning the rights of foreign inmates.

BAIL DENIED TO MAN ACCUSED OF DOWRY HARASSMENT AND SEXUAL ASSAULT OF MINOR SISTER-IN-LAW: ALLAHABAD HC

Case Name: Devideen Vs. State Of Up And 3 Ors.

The Allahabad High Court denied bail to a man accused under the POCSO Act, IPC, and Dowry Prohibition Act for harassing his wife for dowry and enticing away her minor sister subjecting her to sexual assault while noting the seriousness of the accused’s actions, describing them as a breach of both the marital bond and family trust.
