Landmark Dawoodi Bohra Community Succession Case Judgment Awaited

The Bombay High Court is set to deliver its judgment in the decade-long legal battle over the succession of the Dawoodi Bohra community’s spiritual head, Dai al-Mutlaq. The dispute arose after the death of the 52nd Dai, Syedna Mohammad Burhanuddin, in 2014. The case involves two claimants, Syedna Mufaddal Saifuddin and the late Syedna Khuzaima Qutbuddin, with arguments surrounding a secret nass (succession) claimed by Qutbuddin in 1965. The judgment, expected on Tuesday, will hold significant religious and legal implications for the Dawoodi Bohra community, a Shia Muslim group with a global presence of around one million followers.

Denial of Bail to Gang Rape Accused in Pune Case

The Bombay High Court denied bail to Somnath Gaikwad, an accused in a heinous gang rape case that occurred in Pune in October 2020. Gaikwad’s plea for bail based on long incarceration and delayed trial was rejected by the court. The bench emphasized that delay in trial for grave offenses cannot be grounds for bail. The case involved the gang rape of a minor girl by Gaikwad and others, highlighting the need for an expedited trial. The High Court directed the sessions court to conclude the trial within nine months, noting attempts by the accused to influence witnesses and tamper with evidence.

Supreme Court’s Ruling on Women’s Constitutional Entitlement to Child Care Leave

The Supreme Court emphasized women’s constitutional entitlement to participate in the workforce and receive child care leave, particularly in cases involving children with special needs. The case involved a woman, an assistant professor, denied child care leave by the Himachal Pradesh government for her son with a genetic condition. The court noted that denying such leave violates Article 15 of the Constitution. It directed the state to consider granting child care leave to mothers, especially those with children with special needs, in line with the Right to Persons With Disabilities (RPWD) Act. The state was directed to form a committee to address the matter and prepare a report by July 31.

GOVERNMENT SCHEMES

Gharaunda-Group Home for Adults Scheme 

(Ministry of Social Justice and Empowerment- Department of Empowerment of Persons with Disabilities)

Overview:

The Gharaunda-Group Home for Adults scheme, initiated by the Department of Empowerment of Persons with Disabilities, aims to establish Gharaunda Centres or Registered Organizations (ROs) providing quality care services for Adult Persons with Disabilities (PwDs) covered under the National Trust Act. This scheme ensures an assured home and minimum care services for PwDs with Autism, Cerebral Palsy, Mental Retardation, and Multiple Disabilities, promoting assisted living with dignity.

Eligibility Criteria for PwD:

  • PwD must be over 18 years old.
  • PwD must have one of the disabilities listed under the National Trust Act, 1999 (Autism, Cerebral Palsy, Mental Retardation, Multiple Disabilities).

Eligibility Criteria for Registered Organization (RO):

  • RO must be registered with the National Trust.
  • Valid registration under the PwD Act 1995 at the time of enrolment.
  • Ownership or lease of group home land for at least 10 years.
  • Minimum 2 years of working experience with PwDs, with at least 1 year focusing on disabilities under the National Trust Act.
  • Not blacklisted by the National Trust or any other Government Organization.

Green Business Scheme

(Ministry of Social Justice and Empowerment- National Safai Karamcharis Finance and Development Corporation)

Overview:

The Green Business Scheme by the National Safai Karamcharis Finance and Development Corporation (NSFDC) provides financial assistance through loans for income-generating activities that combat climate change. Activities such as Battery Electric Vehicles (E-rickshaws), Solar Energy Gadgets, and Poly Houses are covered under the scheme.

Eligibility Criteria:

  • Safai Karamcharis, Scavengers, and their Dependents are eligible.
  • Quantum of loan up to 90% of unit cost (maximum Rs. 2 lakh).
  • Promoters’ contribution of 10% of the unit cost.
  • Loans based on NSFDC Term Loan Lending Policy, with interest rates varying from 2% to 7%.

Repayment:

  • Repayment within a maximum period of 10 years (including 6 months moratorium).
  • Moratorium period of 120 days allowed for Special Central Assistance (SCA) fund utilization.

These schemes aim to empower and provide sustainable support to persons with disabilities and promote eco-friendly income-generating activities.
