SUPREME COURT SHIFTS AoR EXAMS TO PHYSICAL MODE AFTER ONLINE GLITCHES

Case: Supreme Court Advocate-on-Record Exam Rescheduling

The Supreme Court canceled the online Advocate-on-Record (AoR) exam after technical problems impacted about 120 candidates. Exams will now be conducted in physical mode, with each candidate getting an extra hour per paper. The revised exams will be held at the Judges’ library at the Supreme Court complex.

DELHI HC BANS USE OF “JHANDIYA TV” AND “BAAP KI ADALAT” TRADEMARKS

Case: Independent News Service Private Limited & Anr v Ravindra Kumar Choudhary & Ors

The Delhi High Court prohibited Ravindra Kumar Choudhary from using trademarks “Jhandiya TV” and “Baap Ki Adalat” after a suit by Rajat Sharma and India TV. The court ruled this use infringed on Sharma’s trademark and personality rights, ordering the removal of infringing content from social media.

  • Trade Marks Act, 1999:
    • Section 29: Addresses the infringement of registered trademarks.
  • Personality Rights: Protected under common law and the right to privacy as recognized under Article 21 of the Indian Constitution.
  • Information Technology Act, 2000:
    • Section 79: Requires intermediaries to remove or disable access to unlawful content upon receiving actual knowledge.

EXAM ARRANGEMENT FOR 2006 TRAIN BLASTS CONVICT BY MUMBAI UNIVERSITY

Case: Mohammad Sajid Margub Ansari’s Prison Exam Arrangement

Mumbai University arranged for a law exam to be held for 2006 train blasts convict Mohammad Sajid Margub Ansari at Nashik Road Central Prison. Due to prior escort issues, Ansari missed exams. The High Court supported this method for future cases to address security and logistical concerns efficiently.

GOVERNMENT SCHEMES

AID-GRATIS PENURY GRANT SCHEME

(Ministry of Defence)

Objectives: The Aid-Gratis Penury Grant Scheme aims to alleviate financial distress among destitute non-pensioner Ex-Servicemen (ESM) and their widows up to the rank of Havildar/equivalent.

Benefits: Eligible ESM or their widows receive a monthly financial assistance of ₹4,000, provided annually. This aid is non-transferable and automatically ceases upon the demise of the ESM or widow. Widows can reapply for the grant after the ESM’s demise.

Eligibility:

  • Must be a non-pensioner ESM or his widow.
  • Rank should be Havildar/equivalent or lower from Navy/AF.
  • Age criterion: ESM/widow should be 65 years old on April 1st of the applying financial year.
  • Widow eligibility: Irrespective of age, the widow of a deceased ESM already receiving the grant qualifies for assistance.

FINANCIAL ASSISTANCE FOR PROCURING MOBILITY EQUIPMENT TO DISABLED EX-SERVICEMEN

(Ministry of Defence)

Objectives: The scheme aims to provide financial support for disabled Ex-Servicemen (ESM) post-retirement, enabling them to procure mobility equipment for continued engagement in physically demanding activities.

Benefits: Beneficiaries can avail a maximum financial assistance of ₹1,00,000 for mobility equipment such as modified scooters, crutches, and wheelchairs. They are eligible to reapply for new equipment after 10 years from the date of the previous purchase.

Eligibility:

  • Must be an Ex-Serviceman disabled after retirement.
  • Disability percentage should be 50% or more.
  • Not covered under similar schemes of the Army/Navy/Air Force.
  • Application endorsement required from the respective Zila Sainik Board (ZSB).
  • Ability to personally utilize the provided mobility equipment is essential for eligibility.
